This study analyzes the ideals of responsibility and accountability, asking such questions as when it is legitimate to blame top officials of an organization for mistakes made by personnel below them in the bureaucratic hierarchy; when things go wrong in a large and complex organization like the Canadian Forces, who is responsible and accountable; and whether a plea of ignorance is a good excuse. The study also analyzes the doctrine of ministerial responsibility in both the British and Canadian (...) parliamentary traditions, asking whether it is realistic to expect that a government minister should be held responsible for everything that goes wrong in his/her department. Finally, traditional military values are examined, considering the kinds of attitudes and values expected from Canada's armed forces and the differences between the military and civilian sectors. Canadians frequently have recourse to public commissions as a means of dealing with contentious public policy issues. This essay examines the role of philosophers and philosophy in nine such commissions, all of which have dealt with issues in biomedical ethics. The principal findings of this essay are that philosophers have not been used extensively by these commissions, and that the philosophical aspects of the issues under investigation have been dealt with quite inadequately. Truth and Reconciliation Commissions (TRCs) have become a widely used tool to reconcile societies in the aftermath of widespread injustice or social and political conflict in a state. This article focuses on TRCs that take place in non-transitional societies in which the political and social structures, institutions, and power relations have largely remained in place since the time of injustice. Furthermore, it will focus on one particular injustice that TRCs try to address through the practice of truth-telling, namely the eradication (...) of epistemic injustice. The article takes the Canadian and Norwegian TRCs as two examples to show that under conditions of enduring injustice, willful ignorance of the majority, and power inequality, TRCs might create a double bind for victims which makes them choose between epistemic exploitation and continued injustices based on the majority's ignorance. The article argues that the set-up and accompanying measures of TRCs are of the utmost importance if TRCs in non-transitional societies are to overcome epistemic injustice, instead of creating new relations of exploitation. The Canadian Truth and Reconciliation Commission has been mandated to collect testimonies from survivors of the Indian Residential Schools system. The TRC demands survivors of the residential school system to share their personal narratives under the assumption that the sharing of narratives will inform the Canadian public of the residential school legacy and will motivate a transformation of settler identity. I contend, however, that the TRC provides a concrete example of how a politics of recognition fails to (...) transform relationships between Native and settler Canadians not only because it enacts an internalization of colonial recognition, but because it fails to account for what I call “settler ignorance.” Work in epistemologies of ignorance and epistemic oppression gives language to explain sustained denial and provide tools to further understand how settler denial is sustained, and how it can be made visible, and so challenged. For this task, Mills’s articulation of white ignorance should be expanded to a consideration of white settler ignorance. Over and above an account of white ignorance, such an account will have to consider the underlying logics of settler colonialism. This characterization of settler ignorance will show that the denial of past and ongoing violence against Indigenous peoples, through the reconstruction of the past to assert the primacy of settlers, is not explainable in terms of a lack of recognition but is rather structural ignorance. In settler-colonial Canada, the state does not receive Indigenous testimony as credible evidence. While the state often accepts Indigenous testimony in formal hearings, the state fundamentally rejects Indigenous evidence as a description of the world as it is, as an onto-epistemology. In other words, the Indigenous worldview formation, while it functions as a knowledge system that knows and predicts life, is not admitted to regulatory discussions about effects of resource extraction projects on life. Particularly in such resource-extraction review hearings, partly (...) for obvious reasons of ecological ethics, there is no space for Indigenous relational-ontology. I theorize that beyond racism, white supremacy, and greed, settler-colonial onto-epistemological structures are structured to systematically eliminate the potential for relational-ontologies. This exclusion is complementary to resource-extractivist and legal positivist procedures and is biased against Indigenous knowledge and knowledge-sharing procedures; it is a crisis of state integrity and is philosophically unsound. In my analysis of Canadian National Energy Board documents, I ferret out some of these structures that de facto discredit Indigenous onto-epistemologies; I propose this fundamental problem of the Canadian settler-colonial state must be recognized and changed if the calls of Canada’s Truth and Reconciliation commission are to be met. PurposeThis paper aims to demonstrate the relevance of worldviews of the global south to debates of artificial intelligence, enhancing the human rights debate on artificial intelligence (AI) and critically reviewing the paper of UNESCO Commission on the Ethics of Scientific Knowledge and Technology (COMEST) that preceded the drafting of the UNESCO guidelines on AI. Different value systems may lead to different choices in programming and application of AI. Programming languages may acerbate existing biases as a people’s worldview (...) is captured in its language. What are the implications for AI when seen from a collective ontology? Ubuntu (I am a person through other persons) starts from collective morals rather than individual ethics.Design/methodology/approachLiterature overview on the African philosophy of Ubuntu as applied to artificial intelligence. Application of it to the United Nations Educational, Scientific and Cultural Organisation (UNESCO) debates on establishing guidelines to the ethics of artificial intelligence.FindingsMetaphysically, Ubuntu and its conception of social personhood (attained during one’s life) largely rejects transhumanism. When confronted with economic choices, Ubuntu favors sharing above competition and thus an anticapitalist logic of equitable distribution of AI benefits, humaneness and nonexploitation. When confronted with issues of privacy, Ubuntu emphasizes transparency to group members, rather than individual privacy, yet it calls for stronger (group privacy) protection. In democratic terms, it promotes consensus decision-making over representative democracy. Certain applications of AI may be more controversial in Africa than in other parts of the world, like care for the elderly, that deserve the utmost respect and attention, and which builds moral personhood. At the same time, AI may be helpful, as care from the home and community is encouraged from an Ubuntu perspective. The report on AI and ethics of the UNESCO World COMEST formulated principles as input, which are analyzed from the African ontological point of view. COMEST departs from “universal” concepts of individual human rights, sustainability and good governance which are not necessarily fully compatible with relatedness, including future and past generations. Next to rules based approaches, which may hamper diversity, bottom-up approaches are needed with intercultural deep learning algorithms.Research limitations/implicationsThere is very few existing literature on AI and Ubuntu. Therefore, this paper is of an explorative nature.Practical implicationsThe ethics of Ubuntu offers unique vantage points in looking at the organization of society and economics today, which are also relevant for development of AI, especially in its tenet of relatedness rather than individuality (and practical use of AI for individuals), taking responsibility for society as a whole (such as analyzing the benefit of AI for all strata of society), and embodying true inclusiveness. Whether looking at top-down guidelines for the development and implementation of AI or the bottom-up ethical learning process of AI (deep learning), ethics of the Global South can have an important role to play to combat global individualist tendencies and inequity, likely reinforced by AI. This warrants far more research.Social implicationsApplications of AI in Africa are not contextualized, do not address the most pressing needs of the African continent, lead to cybersecurity issues and also do not incorporate African ethics. UNESCO’s work in this regard is important but expert inputs are largely centered around Western “universal” principles and Organisation for Economic Cooperation and Development and EU precedence. African ethics have, so far, a small role to play in global ethics and philosophy and therefore risk to be overlooked in the discussion on AI and ethics. This is why the consultation process of UNESCO on ethics of AI was of paramount importance. However, it does not automatically lead to consultation of African philosophers or sages, as many are educated in Western (ized) education systems. See further details under practical implications.Originality/valueThis is a new area of research in which little work has been done so far. This paper offers the opportunity to widen the debate on AI and ethics beyond the conventional discourse, involving multiple worldviews, of which Ubuntu is just one. (shrink)

How do we deal with difference personally, interpersonally, nationally? Can we weave a cohesive social fabric in a religiously plural society without suppressing differences? This collection of significant essays suggests that to truly honour differences in matters of faith and religion we must publicly exercise and celebrate them. The secular/sacred, public/private divisions long considered sacred in the West need to be dismantled if Canada (or any nation state) is to develop a genuine mosaic that embraces fundamental differences instead of a (...) melting pot that marginalizes. An ethics of difference starts with a recognition of difference, not as deviance or deficit that threatens but as otherness to connect with, cherish, and celebrate. The book begins with the suggestion that our inability to come to terms with social plurality is not fundamentally the fault of religious differences, and that a public/private split inadequately deals with matters of basic difference. It then explores how encouraging people to live out their respective faiths may open new possibilities for respectful, honourable, and just negotiations of contemporary dilemmas arising out of the multicultural fabric of Canadian life. Towards an Ethics of Community introduces readers to some of the most challenging and divisive dilemmas we face in this increasingly pluralistic, postmodern world — issues such as family and domestic violence, Aboriginal rights, homosexuality and public policy, and female genital mutilation. This article addresses the 2nd Korean consensus conference on cloning that was held by the Korean National commission for UNESCO in 1999. It notes that the citizens participated directly and handled the important social agenda through deliberative process. The consensus conference is another democratic form derived from preference aggregative democracy in the sense that it basically depends on public judgment of the citizens.Compared to other models , it has some advantages: 1. It can solve the problem of political (...) legitimacy. 2. It can check the partiality of expert groups in biotechnology and ethics. 3. It enables us to make informed, responsible decisions. 4. It results in education of citizens’ preference.However, we need to expand the deliberative model. First, we need institutional efforts on behalf of future generations because cloning relates to them. Second, we should not confine deliberation to logical argument, but expand deliberation to include the value of life which cannot be expressed in the form of argument or discourse. (shrink)

The Council for Education in World Citizenship has been working with Kingston University and the UK National Commission for UNESCO, taking advantage of global information technology developments in order to build new programmes for global citizenship education. The paper reports on practical experience, inviting new network partners. The IST-Africa 2007 conference provided an opportunity to build on these foundations, with initiatives in primary, secondary, further, adult and higher education, and continuing professional development for teachers.

Systems of universal health coverage may aspire to provide care based on need and not ability to pay; the complexities of this aspiration call for normative analysis. This special issue arises in the wake of a judicial inquiry into preferential access in the Canadian province of Alberta, the Vertes Commission. I describe this inquiry and set out a taxonomy of forms of differential and preferential access. The history of the concept of “religion” in Western tradition has intrigued scholars for years. This important collection of eighteen essays brings further light to the ongoing debate. Three of the invited participants, W.C. Smith, M. Despland and E. Feil, has each previously written impressive books treating this subject; the last two acknowledged the impact and continuing influence of Smith’s work, The Meaning and End of Religion. Contributors then examine the transformation of words (the classical religio to the modern religion), particularities of religion in nineteenth-century France, Troeltsch’s concept of religion, the study of religion from an Asian point of view and the categorization of “World Religions.” The concluding essays elaborate contemporary anthropological, cross-disciplinary, semiological, deconstructive and psychoanalytical methodological approaches to the concept and study of “religion.” Exploring critically different aspects of the concept and study of religion, these provocative essays typically reflect the methodological pluralism currently existing in the field of Religious Studies. Research on children raises major ethical issues, the most important being the inability of the subjects to provide freely given informed consent. Committees in Canada and the United States charged with formulating recommendations for the protection of human subjects in research came to some fundamentally different conclusions. Two of these are discussed as they apply to children: first the distinction between therapeutic and non-therapeutic research, recognized implicitly by the National Commission and deliberately avoided by the Medical Research Council Working (...) Group ; and second, the looser relation between local committees and Council as defined by guidelines in Canada and the tighter relation between the institutional review committees and the Department of Health, Education and Welfare defined by regulations in the United States. In the article these are considered ethical and legal problems caused by the ongoing pandemic of the new coronavirus disease. New challenges for health care, economy, education not only revealed rather a high level of stability and mobility, but also showed a poor readiness of response to sudden risks, which had a certain impact on all spheres of life of the whole society. The authors have conducted a brief cross-cultural analysis of the issue basing on data quoted by the international (...) network of UNESCO chairs in bioethics, sessions of the Bioethics Committee within the RF Commission on UNESCO affairs, as well as official open sources of the health care system and judicial sphere of the Russian Federation. Strong reciprocal link of legal risks in the interdisciplinary field of medicine and law are made discernable: on the one hand, introduction of sanitary and hygienic regulations are aimed at the realization of the right of protecting the health, while on the other hand they represent a violation of basic human rights. Besides the theoretical approach to the problem of the observance of the constitutional rights of citizens in the pandemic conditions there exists a real threat of their violation due to absence of special mechanisms of their realization in frames of sanitary and hygienic measures with regard to the vulnerable and socially disadvantaged sections in the society. It is made conclusion about necessity of the international collaboration for the purpose of joint decision-making and action in the sphere of health care taking into account an international character of ethical and legal challenges triggered by COVID-19 pandemic, as well as national, economic, cultural and confessional peculiarities. In this paper, I discuss accounts of agency, participation, and self-determination by David Crocker and Stacy Kosko because they acknowledge that relationships of power can determine who gets to participate and when. Kosko usefully applies the concept of agency vulnerability to the case of the self-determination of indigenous peoples. I examine the specific context of Canada’s history as a settler nation, a history that reflects attempts to denigrate, dismiss and erase Indigenous laws, practices, languages, and traditions. I argue that this (...) history displays epistemic injustice in that the dominant collective interpretative resources of non-Indigenous Canadians have allowed the dismissal of the collective interpretative resources of Canada’s Indigenous peoples. This gap in collective interpretative resources can explain that Canada’s constitution, institutions, laws, and structures reflect the dominant collective interpretative resources of a colonizing nation, ones that have delineated and restricted the agency, participation, and self-determination of Indigenous Canadians. One important outcome of Canada’s Truth and Reconciliation Commission and of its National Inquiry into Murdered and Missing Indigenous Women and Girls is bringing the rich history of Indigenous collective interpretative resources and the networks of relationships shaped by them to light. By discussing examples from these reports, I give substance to the argument that foundational and structural injustices in settler nations are at bottom epistemic injustices, ones that have implications for accounts of agency, participation, and self-determination. His wife and companion of sixty years, Muriel, survives him, as (...) do five children and a dozen grandchildren.Smith, a Protestant Christian and clergyman, played an influential role among both academics and church bodies in advocating open dialogue and personal encounter with the adherents of diverse religious traditions. As one of his students, Professor John Ross Carter of Colgate University, put it, "Before I met Wilfred, I had studied Buddhism as a system. Under him, I came to appreciate the faith of Buddhists as persons."As an undergraduate, Smith studied Middle Eastern languages at the University of Toronto. He then studied theology in Cambridge, England, and taught during the early 1940s at Forman Christian College, Lahore, in what was then India but is now Pakistan. He became involved in the vital contemporary life of Muslims, and in the Hindu-Muslim-Sikh interface in the Punjab. The partition of India along communal lines in 1947 reinforced his strong sense of the moral urgency of interreligious understanding.After completing a Ph.D. degree at Princeton University with a dissertation on modern Islam, Smith took up the chair of comparative religion in McGill University's Faculty of Divinity and soon organized McGill's Institute of Islamic Studies, which he directed until 1963. The institute was innovative in two respects. First, it treated Islam as the faith of millions in southern Asia today, where the numerical majority of Muslims live, in contrast with the emphasis of most Orientalist scholarship on classical Arabic, Persian, and Turkish literature. Second, it strove to include roughly equal numbers of Muslims and Westerners in both its faculty and its student body.Though he had already made seminal contributions to comparative studies, Smith moved fully into that realm when in 1964 he took over the directorship of Harvard Divinity School's Center for the Study of World Religions, and later, of Harvard's entire graduate program in religion in arts and sciences. The purpose of this work is to offer a critical examination of Immanuel Kant's ethic of suicide. Kant's suicidology marks an influential view regarding the moral stature of suicide, yet one that remains incomplete in important respects. Because Kant's moral views are rationalistic, they restrict moral consideration to rational entities. Many people who commit suicide are not rational at the time of its commission, for they suffer from severe mental illness. Because of this, Kant's suicidology devastatingly excludes certain human (...) demographics from moral consideration, current Canadian statistics indicating that such people mark one of the highest populations at risk of committing suicide in the first place. This work contains a presentation, analysis, and critique of Kant's ethic of suicide, leading to an attempt to state criteria for an adequate suicidology.Dept. of Philosophy. This issue of Diogenes includes short papers by prominent officers of 18 of the member-associations of the International Federation for Modern Languages and Literatures (Fédération Internationale des Langues et Littératures Modernes - FILLM) with a view to introducing and explaining the history, purpose, and function of these international learned societies representing different branches of the modern languages field at a time when the role of such bodies is often questioned even by professional academics working within the discipline, and their very (...) existence largely unknown outside it, even to educated persons. The FILLM is one of the earliest member organizations of the International Council for Philosophy and Humanistic Studies (CIPSH) which had indeed had a prior existence since its foundation in Oslo in 1928 as the Commission Internationale d'Histoire Littéraire Moderne and was subsequently reorganized in its present structure in 1951 following the formation of UNESCO. The conference was held under the auspices of the Union, The Social Sciences and Humanities Research Council of Canada, and the Canadian Society for History and Philosophy of Science. The meetings took place in Montreal, Canada, 25-29 August 1980, with Concordia University as host institution. The program of the (...) conference was arranged by a Joint Commission of the International Union of History and Philosophy of Science consisting of Robert E. Butts (Canada), John Murdoch (U. S. A. ), Vladimir Kirsanov (U. S. S. R. ), and Paul Weingartner (Austria). The Local Arrangements Committee consisted of Stanley G. French, Chair (Concordia), Michel Paradis, treasurer (McGill), Fran~ois Duchesneau (Universite de Montreal), Robert Nadeau (Universite du Quebec it Montreal), and William Shea (McGill University). Both committees are indebted to Dr. G. R. Paterson, then President of the Canadian Society for History and Philosophy of Science, who shared his expertise in many ways. Dr. French and his staff worked diligently and efficiently on behalf of all participants. The city of Montreal was, as always, the subtle mixture of extravagance, charm, warmth and excitement that retains her status as the jewel of Canadian cities. These features, while obviously undesirable, were she felt, reliable indices of societal maturation. This anecdote is suggestive in understanding current events pertaining to the field of applied ethics.Philosophers have produced a massive body of opinion and argument on a diverse range of subjects under the (...) rubric of applied ethics. Moreover, they have assumed positions on various panels, commissions, governmental bodies and committees in the hope of making an informed contribution to the formulation of institutional and public policy. These accomplishments have begun to elicit the kinds of attributes commonly associated with philosophical maturation — exposées, debunkings, refutations, and ideologically informed critiques. In this paper, we explore the concept of bearing witness in nursing practice. We examine the description of bearing witness in the nursing literature, particularly that offered by William Cody who suggests that bearing witness results in the limited moral obligation of “true presence.” We then turn to Lorraine Code's work on testimony, drawing parallels between the concepts of testimony and bearing witness. Code suggests that receiving testimony results in a responsibility to respond, and that this is an ethico‐political obligation. (...) We discuss these ideas in relation to a Canadian exemplar of witnessing the Truth and Reconciliation Commission of Canada's work to understand and address the historical injustices done to Indigenous peoples in Canada. Here, we focus on the Commission's definition of witnessing and highlight the experience of Shelagh Rogers who served as an honorary witness. As an outcome of our analysis, we suggest that bearing witness in nursing practice is most usefully conceptualized as both a moral and a political obligation. Implications for nursing practice are suggested, including first, the need to critically examine our own understandings of power and privilege in order to authentically bear witness and avoid being complicit in injustice, and second, the concomitant responsibility to take action to challenge injustice once we have borne witness to it. BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 (...) participants (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. Far from merely rejecting the ongoing political reform, the coordination of the « intermittents and précaires » proposes a reform project based on the reality of the discontinuity of labor. The aim is not a melancholy plea for the creation of some hypothetical « real jobs n, but rather, to demand the means which are required for the practices of intermittence to be placed on a solid, permanent basis. The model of unemployment compensation suggested here should enable these practices to (...) be rendered permanent, thereby guaranteeing the linkage of various temporalities as a condition for acting on the meaning and content of activity, through forms of shared benefits which grant indemnities to those with lower income and sacrifice those with a higher income. This presupposes the creation of a real threshold of indemnities but also a minimum wage-type platform. What remains to be thought is other forms of financing which would do justice to the frequently unacknowledged production of wealth in intermittence. (shrink)

In 1987, the World Commission on Economic Development popularized the term “sustainable development” in its well-cited report, Our Common Future. According to this report, sustainable development is defined as “the development that meets the needs of the present without compromising the ability of future generations to meet their own needs.” The WCED asserted that sustainable development required simultaneous adoption of environmental, economical, and equity principles. The study found that both resources based and institutional factors influence corporate sustainable development. This paper studied the corporate sustainable development of Mysore Paper Mills Ltd. from 1995 to 2011 using the same model. The study found that independent variables with significant impact on environmental integrity and overall sustainability were fines, penalties, court cases involved by the company, and log of total assets. On economic prosperity, the independent variable with significant impact is log of total assets. For social equity, the independent variable with significant impact is foreign sales as percentage of total sales, number of fines/penalties/court cases, number of fines/penalties/court cases, log, and return on equity. ABSTRACTSince the release of the Final Report of the Canadian Truth and Reconciliation Commission, many non-Indigenous Canadians, politicians, and educational and cultural institutions have embraced reconciliation. Yet, many Indigenous people in Canada remain skeptical. In this article, I examine six reasons Indigenous people may resist reconciliation. Reconciliation may aim to restore a relationship that never existed in the first place, and may limit an Indigenous future. Reconciliation may look more like adaptation than transformation. Reconciliation may serve as a (...) government project whose primary aim is to bolster state legitimacy. Reconciliation may reflect the desire, for settler-descendants, for expiation or a ‘move to innocence.’ Ultimately, reconciliation is about living together, which may be incompatible with more transformative political projects, such as decolonization. Introduction: Medical ethics raises the question of the meaning of medical practices in light of the humanities. In France, the spaces for ethical discussion (SED) are multiple and heterogeneous. The objective of this study was to investigate the typology and functioning of SEDs in the health field. Methods: Twenty-one semi-structured interviews were conducted with members of eleven different SEDs in France. The data were analyzed according to the basic steps of qualitative research: coding, categorization, linking and presentation of results. Results: (...) The five categories of SEDs (National Consultative Ethics Committee, Regional Ethical Reflection Spaces, Ethics Commissions of Medical Learned Societies, Research Institute Ethics Committees, Hospital Ethics Committees) all differ in their links with institutions, their composition, their choice of themes discussed and the presentation of their work. However, they all agree on the following points: the importance of multi-disciplinarity, the frequency of working meetings, the sense of ethical commitment, the absence of professional recognition, the difficulty of valorizing work and the lack of recognition by peers. The respondents regret that there is insufficient coordination between the different SEDs, although their work may be complementary. Conclusion: Opening up the SEDs and encouraging their articulation, without distancing them from the practice of care, could promote the visibility of their ethical approach in the daily lives of caregivers. Finally, if ethical reflection is encouraged by the scientific community as a whole, greater recognition is desired by professionals who participate in applied ethics research. (shrink)

This work examines the development and performance of federal independent regulatory bodies in Canada in the period up to 1979, with particular attention to the operation of legislative schemes that include executive review and appeal powers. The author assesses the impact of the exercise of these powers on the administrative law process, and proposes new models for the generation, interpretation, implementation, review, and enforcement of regulatory policy. The study includes a series of representative case studies based on documentation and extensive (...) interviews with individuals drawn from government, agencies, and other parties, including counsel for public interest groups. This enables author, writing from her experience as a participant-observer embedded in the public interest legal sector, to draw on the experiences and perspectives of a broad range of participants in the regulatory process, including but not limited to those dealing with the regulated energy, transportation, communications, and foreign investment sectors. Legal principles identified as emergent in leading judicial decisions in administrative law are used to assess the powers and practices used in executive reviews and appeals. The author finds those powers and practices to be flawed and proposes changes. The proposed models are designed to accord with emerging legal principles and avoid flaws of the types identified in the review and appeal provisions. This work, written under contract with the Administrative Law Project of the Law Reform Commission of Canada, formed one part of a comprehensive study of administrative law at the federal level in Canada.
